BY USING THIS SERVICE A USER AGREES TO BE BOUND BY ALL TERMS AND CONDITIONS STATED IN THIS AGREEMENT AND ANY OPERATING REGULATIONS ISSUED BY COMPANY AND INCORPORATED HEREIN BY REFERENCE.

bwanjiNET reserves the right to modify these terms and conditions at any time by posting the changes on our web site. It is your responsibility to check these terms and conditions periodically to ensure that you are in compliance with the current Terms and Conditions.

1. The service

bwanjiNET is providing an Internet service that brings the ability for the public to search among other things: company, website, product or service and for the owners of this information to post and update their own information regularly.

2. The Customer

The information posting service is provided to registered users, hereinafter referred to as "the Customer".

Registration to the system is FREE of charge to the Customer.

On registration to the service, the Customer agrees to:

(1) Fill out the registration form in current, complete, and accurate data about the Customer as it is prompted to be done,

(2) Maintain and promptly update this data as a current, complete and accurate ones,

(3) Accept to Terms of Service stated herein,

On registration to the service, the Customer agrees to act complying with the provisions of the Terms of Service.

On registration to the service, the Customer agrees to receive information about updates, enhancements and general notices about the service.

The Customer is solely responsible for the content of the materials which they post to the service.

The Customer understands and agrees that bwanjiNET may present advertisements within the bwanjiNET website.

The Customer expressly agrees that use of the service is at his or her solid risk.

3. Free Account

Customer agrees that they will be limited in the number of items they shall be able to post to the service.

The Customer understands the the Free account is limiting in nature and the some of the facilities that are made available to the Paid account may not be available to Customers of the Free account.

The Customer is able to upgrade their Free account to a Paid account at any time by paying their monthly subscription fees.

The Customer is also able to downgrade their Paid account to a Free account by withholding the renewal of monthly subscription charges.

4. Technical requirements

bwanjiNET assures that the service will work properly on Windows 95/98/NT/2000/Me/XP platform with Internet Explorer 5.0 or higher.

Browser scripting settings must be enabled.

The Customer realizes that a service is provided on an as is basis.

5. Customer obligations

The Customer is obliged to provide accurate, and true registrant contact details, and keep such contact details up to date.

If the Customer provides any information that is untrue, inaccurate, not current or incomplete, or bwanjiNET has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, bwanjiNET has the right to suspend or terminate your account and refuse any and all current or future use of the service.

The Customer may not use any hardware or software intended to damage or interfere with the proper and timely functioning of the service or to surreptitiously intercept any system, data or personal information from the bwanjiNET website and/or the service.

The Customer may not take any action which imposes an unreasonable or disproportionately large load on the website network or other bwanjiNET services infrastructure.

The Customer may not post service information of another organization or individual, without the owner's prior consent.

bwanjiNET reserves the right to refuse access to the website, terminate accounts, remove content, at its sole discretion. bwanjiNET reserves a right to refuse any and all current or future use of the service to the Customer who intentionally or maliciously evades the obligations stated in these Terms of Service, or arising from custom, and other best practices of conduct in the Internet.

If bwanjiNET finds the Customer intentionally or maliciously evades the obligations, bwanjiNET may take action immediately, including disabling the customer's account, and terminating a service and/or reporting the Customer and the incident to the proper authorities.

6. Abusive and illegal practices

The Customer is not allowed to associate any content provided through the service with pornography, adult rated material, child pornography, bigotry, racism, hatred, profanity, mail fraud, or any material which may be insulting to another person or company.

Using the services to promote any material that, intentionally or unintentionally, violates any applicable local, state, national or international laws, or any rules or regulations promulgated there under.

Without limiting the general prohibitions against all illegal practices, the following are expressly prohibited:

(1) Use the service to harm, or attempt to harm, minors in any way,

(2) Use the service to promote any material that threatens or encourages bodily harm or destruction of property,

(3) Use the service to promote any material that consists pornography, adult rated material, or child pornography,

(4) Use the service to make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam,

(5) Attempt to impersonate any person or service by using identifying information such as name, nickname, domain name, or email address.

7. Copyright

All content included on the bwanjiNET website, such as text, graphics, logos, images, is the property of bwanjiNET or its content suppliers and protected by international copyright laws. No part of this website may be reproduced or transmitted in any form or by any means without written permission from the authors.

8. Disclaimer of warranties, limitation of liabilities

BWANJINET DOES NOT WARRANT, FOR THE WEBSITE AND THE SERVICE IT IS PROVIDING. BWANJINET DISCLAIMS ANY WARRANTY OF TITLE, MERCHANTABILITY, NON-INFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE WILL BE ERROR FREE OR UNINTERRUPTED. THE SERVICE AND THE WEBSITE ARE DISTRIBUTED ON "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED.

bwanjiNET is not responsible for any delay or failure in performance due to Force Majeure, or other occurrences that are beyond bwanjiNET reasonable control. bwanjiNET is not responsible for short, temporarily and accidental suspension of the service as a result of circumstances which bwanjiNET could not foresee nor suspect.

Customer recognizes that bwanjiNET does not own or control other networks, information and systems outside of its own network, nor is bwanjiNET responsible for performance or non-performance within such networks. bwanjiNET exercises no control over and specifically denies any responsibility for the content, information, accuracy or quality of the information and/or data passing through its Network or the service provided.

The use of the service is at the Customer's solid risk. bwanjiNET is in no way responsible for the conduct of its Customers, and/or the content of messages sent through the system. bwanjiNET is not responsible for any indirect, incidental, special, punitive, or consequential damages that result from Customer's or Customer's users' use of the service, including, without limitation, any such damage for loss resulting from service interruptions, delays, non-deliveries, and/or miss-deliveries.

bwanjiNET shall have no liability for any damages suffered by the Customer or any third party as a result of the use or the misuse of the service.

9. Final provisions

bwanjiNET reserves the right to modify, add or delete any documents, information, graphics or other content appearing on or in connection with the bwanjiNET website, including these Terms of Service, at any time without notice.
